The Civil Coalition for Transitional Justice and civil society organizations received with great dismay and anger the issuance of an arrest warrant against the President of the Truth and Dignity Commission (IVD) and human rights activist, Ms. Sihem Ben Sedrine, on the first of August 2024.

The signatories to this statement believe that the legal pursuit and prosecution of Ms. Sihem Ben Sedrine on malicious charges not only falls within a political context characterized by the suppression of all dissenting, free, and human rights voices and the systematic dismantling of all intermediary institutions, but it is also an act of persecution clearly aimed at nullifying the final report of the IVD, which sought to dismantle the system of corruption and tyranny established before the 2010-2011 Revolution. Such attempts aim to exonerate the perpetrators of previous regimes and ensure their impunity, depriving victims of their basic human rights to dignity and reparation. This prosecution is additionally a blatant a violation of Organic Law No. 53 of 2013 dated December 24, 2013, Establishing and Organizing Transitional Justice, specifically its 69^th article, which prohibits prosecuting commission members based on the contents of the final report while it is still in effect.

The prosecution and judicial harassment of Sihem Ben Sedrine reflect a vindictive and selective approach by a regime that has chosen to use all its apparatus to target human rights defenders or resurrect old cases, while maintaining judicial silence and complete immunity for those who violated rights and freedoms during the era of dictatorship. The judiciary under the executive authority has indeed systematically obstructed nearly 205 cases referred by the IVD to the judiciary against 1,500 individuals (including 1,200 affiliated with the Ministry of Interior) accused of the most severe human rights violations such as deliberate killing, torture, enforced disappearance, misuse of public funds, among others.

The Civil Coalition, along with its partners from various associations and organizations, has previously expressed concerns about numerous attempts by the authorities to shut down the transitional justice process both before and after July 25, 2021.

Since the President assumed power, there have been numerous attempts to undermine all the gains of the Revolution and the transitional justice process. The authority has sought to create a parallel process through the Reconciliation Law, denying victims their rights to justice and reparation, paralyzing the specialized judicial chambers through arbitrary judicial transfers, all the while repeatedly promoting those accused of violations during the dictatorship, and involving some of them in contributing to a unilaterally drafted constitution in 2022. These continuous and repeated efforts aim to deny the country’s history and bury the truths of corruption and tyranny from decades of dictatorship, wasting the rights of victims who believed in the path of transitional justice and justice in general after the fall of dictator Ben Ali in 2011.

Therefore, the Civil Coalition for Transitional Justice and civil society organizations express:

• Their condemnation and denunciation of the judicial harassment, including travel bans and judicial pursuits culminating in the issuance of an arrest warrant on August 1st, faced by the President of the Truth and Dignity Commission, Ms. Sihem Ben Sedrine, for her work with IVD commission.
• Their absolute and unconditional solidarity with the President of the Truth and Dignity Commission, the activist against Ben Ali’s tyranny, Ms. Sihem Ben Sedrine, demanding the cessation of malicious and retaliatory pursuits against her and her immediate release, especially since it blatantly violates the 2013 Transitional Justice Law in its article 69.
• Their condemnation of the State’s continued use of all its apparatus to undermine the country’s achievements, deny justice to victims, and explicitly target those who worked to hold perpetrators accountable, while ensuring absolute impunity for those who stole, looted, tortured, and killed the Tunisian people for decades.
• Their rejection of the judiciary’s subjugation and manipulation according to electoral agendas to eliminate opposition and silence critics, harassing human rights defenders, former commission heads, and actors of civil society, political opponents, and trade unionists, rather than maintaining an independent judiciary that effectively pursues perpetrators and human rights violators.

La Coalition de la Société Civile pour la Justice Transitionnelle et les organisations de la société civile ont accueilli avec une grande consternation et colère l’émission d’un mandat d’arrêt contre la Présidente de l’Instance Vérité et Dignité (IVD) et militante des droits de l’homme, Mme Sihem Ben Sedrine, le premier août 2024.

Les signataires de ce communiqué estiment que la poursuite judiciaire et la persécution de Mme Sihem Ben Sedrine sur la base d’accusations malveillantes s’inscrivent dans un contexte politique marqué par la suppression des voix dissidentes, libres et des défenseurs des droits de l’homme. Cette situation reflète également une volonté manifeste d’annuler le rapport final de l’IVD, qui vise à démanteler le système de corruption et de tyrannie en place avant la Révolution de 2010-2011.

De telles tentatives visent à exonérer les auteurs des régimes précédents et à assurer leur impunité, privant ainsi les victimes de leurs droits humains fondamentaux à la dignité et à la réparation. Cette poursuite constitue en outre une violation flagrante de la Loi organique n° 53 de 2013 du 24 décembre 2013, relative à l’instauration de la justice transitionnelle et son organisation, en particulier son article 69, qui interdit de poursuivre les membres de la commission sur la base du contenu du rapport final.

La poursuite et le harcèlement judiciaire visant Sihem Ben Sedrine illustrent une approche vindicative et sélective de la part d’un régime qui a choisi d’utiliser tous ses moyens pour cibler les défenseurs des droits de l’homme et raviver d’anciennes affaires. Parallèlement, il maintient un silence judiciaire et une impunité totale pour ceux ayant violé les droits et les libertés durant l’ère de la dictature.

En effet, l’appareil judiciaire sous l’autorité exécutive a systématiquement bloqué près de 205 affaires référées par l’IVD, impliquant 1 500 personnes (dont 1 200 affiliées au ministère de l’Intérieur) accusées des violations les plus graves des droits de l’homme, telles que le meurtre délibéré, la torture, la disparition forcée et l’abus de fonds publics, entre autres. La Coalition pour la Justice Transitionnelle, avec ses partenaires de diverses associations et organisations, a déjà exprimé ses inquiétudes concernant les nombreuses tentatives des autorités de mettre fin au processus de justice transitionnelle avant et après le 25 juillet 2021.

Depuis l’accession au pouvoir du président actuel, de nombreuses tentatives ont été faites pour saper les acquis de la Révolution et du processus de justice transitionnelle. Le régime de Kais Saied a en effet cherché à mettre en place un processus parallèle à travers la loi de réconciliation, niant ainsi aux victimes leurs droits à la justice et à la réparation. Il a également paralysé les chambres judiciaires spécialisées par des mutations judiciaires arbitraires et promu à plusieurs reprises des individus accusés de violations sous la dictature. Certains ont même été impliqués dans la rédaction unilatérale de la constitution par le président en 2022. Ces efforts continus visent à nier l’histoire du pays et à enterrer les vérités sur la corruption et la tyrannie des décennies de dictature, tout en compromettant les droits des victimes qui avaient cru en la justice transitionnelle et en la justice en général après la chute du dictateur Ben Ali en 2011.

Par conséquent, la Coalition Civile pour la Justice Transitionnelle et les organisations de la société civile signataires de ce communiqué :

• Condamnent et dénoncent harcèlement judiciaire, y compris les interdictions de voyager et les poursuites judiciaires culminant par l’émission d’un mandat d’arrêt le 1er août, subis par la Présidente de l’Instance Vérité et Dignité, Mme Sihem Ben Sedrine, pour son travail au sein de l’IVD ;

• Expriment leur solidarité absolue et inconditionnelle avec Mme Sihem Ben Sedrine, Présidente de l’Instance Vérité et Dignité et militante contre la tyrannie de Ben Ali. Ils exigent l’arrêt immédiat des poursuites malveillantes à son encontre et demandent sa libération sans délai, soulignant que ces actions violent de manière flagrante l’article 69 de la loi sur la justice transitionnelle de 2013 ;

• Condamnent l’utilisation persistante par l’État de tous ses moyens pour saper les réalisations du pays depuis 2011, nier la justice aux victimes, et cibler explicitement ceux qui ont œuvré pour rendre les auteurs responsables, tout en garantissant une impunité totale à ceux qui ont volé, pillé, torturé et tué le peuple tunisien pendant des décennies ;

• Ils rejettent la subjugation et la manipulation du pouvoir judiciaire selon des agendas électoraux pour éliminer l’opposition et faire taire les critiques. Cela inclut le harcèlement des défenseurs des droits de l’homme, des anciens présidents de commissions, des acteurs de la société civile, des opposants politiques et des syndicalistes. Au lieu de maintenir un pouvoir judiciaire indépendant qui poursuit efficacement les auteurs et les violateurs des droits de l’homme, ces pratiques compromettent l’intégrité du système judiciaire.

The OMCT is seeking to recruit highly motivated, energetic, and creative individual with a commitment to human rights for an internship of three (03) months.

About the OMCT

The World Organization Against Torture (OMCT) is an international non-profit organization. The OMCT works with 200 member organizations that fight to end torture and ill-treatment, assist victims, and protect human rights defenders at risk, wherever they may be.

Since September 2020, the OMCT’s Libya program works in close collaboration with the Libyan Anti-Torture Network (LAN) to tackle torture and institutionalized violence by state and non-state actors through capacity-building, organizational empowerment, legal aid and advocacy. Through this project, the OMCT aims to plant the seeds for a richer and more resourceful civil society landscape that would allow human rights activists and civil society organizations to path the way for long-term anti-torture activities leading to more transparency and accountability for criminal acts.

TERMS OF REFERENCES

• To assist with the drafting, editing and the translation of briefings and documents of the OMCT Libya program in its programmatic areas (English <=> Arabic).
• To attend meetings and trainings organized by the Libya program and prepare notes.
• To assist with the organization of seminars, trainings, and conferences.
• To curate and prepare weekly press digests on the situation in Libya.
• Potentially, to assist with the documentation of individual cases.

Qualifications required

• University studies/degree in law, international relations, political or social sciences or any related field.
• Good knowledge and understanding of international human rights law.
• Good drafting and editing skills.
• Good interpersonal and communication skills.
• Able to meet deadlines and work on various tasks in a multicultural environment.
• Excellent oral and written communication skills in the following languages: English and Arabic. French is an asset.
